`IT IS HEREBY ORDERED this ______ day of _______, 2017, that Defendants’ Motion

`to Compel is GRANTED. Plaintiff shall:

`(1) be precluded from accusing any broadcast channel;
`
`(2) be precluded from accusing any method;
`
`(3) be precluded from arguing that the Accused Products practice the Broadcasting

`Limitations as described in elements 1-c, 1-d, 13-e, and 13-f in the ‘344 and ‘966, and claim 22
`
`of the ‘634 patent charts;

`(4) be precluded from arguing that the Accused Products practice the Connect or

`Disconnect Limitations as described in elements 1-b, 1-e and 1-f of the ‘069 patent chart and

`elements 1-b, 1-c, 11-b, and 11-c of the ‘147 patent chart;

`(5) be precluded from asserting infringement under the doctrine of equivalents;

`(6) be precluded from accusing any networks other than those specifically identified in its

`
`(7) be precluded from asserting any factual allegations other than those specifically cited
`
`in its responses to interrogatories 7 and 9.
`
`Furthermore, Plaintiff shall pay a monetary sanction of Defendants’ expenses incurred as
`
`a result of Plaintiff’s failure to give discovery and comply with the Special Master’s Order Nos.
`
`2 and 3. Defendants shall submit to the Special Master an accounting of the expenses incurred.

`
`Without leave of Court, only the following expert reports shall be permitted:
`
`a. Opening expert reports
`
`b. Rebuttal expert reports
`
`c. Reply expert reports
`
`d. No other expert reports will be permitted without either the consent of all
`
`parties or leave of the Court, and expert reports may not be supplemented
`
`without either the consent of all parties or leave of the Court.
`
`2.
`
`All expert testimony must be supported by an expert report under FRCP 26
`
`(a)(2)(B) (as opposed to FRCP 26 (a)(2)(C)).
`
`3.
`
`The page limits for expert reports shall be as follows:
`
`a. All expert reports shall conform to the font and spacing requirements of LR
`
`5.1.1(a)
`
`b. The sum total of all expert reports for each side in each case shall be 1,500
`
`pages, excluding CVs. This total applies to substantive attachments such as
`
`claim charts, appendices, and lists of supporting materials.
`
`c. If patents or issues are removed from the case, the parties shall promptly meet
`
`and confer to determine whether the page limits should be reduced, and shall
`
`request a call with the undersigned if they are unable to agree on revised page
`
`limits.
`
`4.
`
`Expert reports shall:
`
`a. Have a clear and concise summary of all opinions to be provided at trial and
`
`the basis and reasons for them at the beginning of the report;
`
`b. For each opinion, an expert shall identify the materials the expert relied upon
`
`by specificity (e.g. by Bates number or exhibit number (if a document), or by
`
`

`deposition page and line number (if a deposition), or by line number (if source
`
`code).
`
`c. In identifying materials relied upon, an expert shall explain clearly how those

`materials provide support for the expert’s opinions.

`
`An expert shall not:
`
`a. Testify on matters not clearly disclosed in the expert’s report;
`
`b. Offer or expand upon opinions or bases for opinions not clearly stated in the
`
`expert report;
`
`c. Use or refer to evidence not disclosed and clearly explained in the expert’s
`
`report.
`
`6.
`
`Expert depositions:
`
`a. In each case, an expert may be deposed for up to 7 hours per report, and an
`
`additional 7 hours for each 200 pages over the first 200 pages (e.g. a 400 page
`
`expert report would allow for up to 14 hours of deposition time).
`
`b. If an expert submits the same report (e.g. invalidity/validity) in more than one
`
`case, the deposition shall be treated as if it was a single report rather than 3
`
`reports. The page limits above shall apply.
