`Facebook submits this letter pursuant to D. Del. LR 7.1.2(b) to advise the Court of a
`
`subsequent development relevant to the Facebook’s pending Motion to Stay (D.I. 164). On
`October 20, 2017, Unified Patents, Inc. filed a petition for inter partes review challenging claims
`1-3 and 8-10 of U.S. Patent No. 6,125,371 (the ’371 patent), the same claims asserted against
`Facebook in this action. (Ex. A). As discussed in the briefing on Facebook’s Motion to Stay,
`claims 8-10 were instituted, but claims 1-3 were not in the Patent Trial and Appeal Board’s prior
`decision on Facebook’s inter partes review petition for the ’371 patent.
