`Pursuant to Your Honor’s Order Setting Rule 16(b) Conference [D.I. 11] and in
`preparation for the conference scheduled for 3 pm on Tuesday, September 22, 2015, the parties
`have conferred regarding scheduling and discovery limitations. With one minor exception, the
`parties have reached agreement on the terms of the proposed Scheduling Order.

`We enclose for Your Honor’s consideration the parties’ proposed Scheduling Order. As
`Your Honor will read, the parties are not in agreement on the proposed trial dates in Paragraph
`16. Plaintiff is requesting a trial in June or July 2017 and Defendant is requesting a trial in May
`201 7.
