`Thank you for the productive meeting after the hearing yesterday. I write to memorialize our various requested
`follow-up items. Please let me know if any of the following does not accurately reflect our discussions.
`
`The date for Acceleration Bay’s infringement contentions has been moved to March 2, 2016, and the date for
`Defendants’ invalidity contentions has been moved to May 6, 2016.
`
`Please provide proposed dates for the 30(b)(6) depositions of the Defendants. As discussed, we would like to
`begin with a designee able to speak to the multiplayer, networking and server-interconnection functionality for
`each of the accused games (we would also cover other noticed topics for which the witnesses are
`knowledgeable). It may make sense to begin with Take-Two, given your representation that no Take-Two
`documents will be forthcoming.
`
`As requested in our December 18, 2015 letter to Mike and subsequent follow-ups, please as soon as possible
`update Defendants’ ESI disclosures to identify any third-party sources of relevant source code. In particular, to
`the extent any of Defendants’ games rely on third-party source code, developer kits, software or servers to
`provide the multiplayer functionality, please let us know now so that Acceleration Bay may timely seek core
`technical discovery from those third parties.
`
`Please let us know when the World of Warcraft wiki is available for inspection. We request that the sections of
`the World of Warcraft and Call of Duty wikis relating to networking and multi-player functionality be produced
`with the source code redacted.
`
`Please produce redacted copies of the main design document for each of the Activision Call of Duty games
`(located in the technical documents folder), the text files with “mp” in the title (also located in the Call of Duty
`technical documents folder) and the Activision documents attached as exhibits to Defendants’ letter brief. Next
`week we will provide a list of additional requested game design and specification documents.
`
`Finally, as discussed, we expect to serve productions in response to the various outstanding subpoenas
`tomorrow. Please let us know when Defendants will complete the production of technical documents
`referenced in Mike’s January 11, 2016 email, and when we should expect the Destiny documents from
`Activision.

`functionality of the accused products.”  We do not yet have Plaintiff’s infringement 
`contentions.  Therefore, we ask that you identify the specific accused functions you contend 
`are not “fully disclosed” and explain why the code that has been produced does not disclose 
`the relevant aspects of those accused functions.  Once we have that information, we can 
`determine whether additional source code should be produced.  We are, of course, happy to 
`work with you to identify any relevant code that you believe is missing. Finally, if you have any 
`authority that suggests that we are required to produce “the complete code for the accused 
`products,” please send it to us for review.

`As discussed in our letter of January 21, 2016 and reiterated during our meet and confer today, the very limited source 
`code provided by Take2 to date does not fully disclose the relevant functionality of the accused products.  As you know, 
`Take2 is relying entirely on source code to satisfy its core technical production obligations.  Accordingly, please confirm 
`by no later than close of business on Tuesday that Take2 will make available for inspection the entire source code for the 
`accused GTA V and NBA 2K games.  If not, we will seek relief from the Court. 

`During our meet and confer today you asked me to provide you with some examples that you can provide to your client 
`of how multiplayer functionality is integrated into the GTA V and NBA 2K games.  As I explained during our call and as 
`discussed in the complaint against Take2, GTA V’s open world, jobs, social club, team death match, heists, come out to 
`play, siege mentality, and hasta la vista modes are all examples of modes that involve multiplayer functionality.  Similarly 
`and by way of example, the NBA 2K games offer a variety of multiplayer functions and modes, such as online leagues, 
`MyPARK, Rec Hall, Stage.  All of these functions and modes interact with the multiplayer networking functionality of 
`these games.

`We are in receipt of the your letter of January 21, 2016. 

`Your letter asserts that the source code produced “does not fully disclose the relevant 
`functionality of the accused products.”  We do not yet have Plaintiff’s infringement 
`contentions.  Therefore, we ask that you identify the specific accused functions you contend 
`are not “fully disclosed” and explain why the code that has been produced does not disclose 
`the relevant aspects of those accused functions.  Once we have that information, we can 
`determine whether additional source code should be produced.  We are, of course, happy to 
`work with you to identify any relevant code that you believe is missing. Finally, if you have any 
`authority that suggests that we are required to produce “the complete code for the accused 
`products,” please send it to us for review.   

`Lastly, please advise whether you still intend to proceed with a Rule 30(b)(6) deposition of 
`Take Two at this time.  As noted, we will not produce witnesses twice.

`As I indicated, I believe that all Demonware code that is compiled into any of the accused Call 
`of Duty games has been produced – and indeed, I believe some of it has been printed by your 
`source code review team.

` patent lawsuit does not give a plaintiff the right to unfettered access to all of a defendant’s 
`files, or for that matter a defendant’s subsidiary’s files.  Demonware is a foreign subsidiary and 
`is not a party to the case. Nor is any Demonware product accused of infringing any patent in 
`the First Amended Complaint.  Moreover, the discovery you are requesting is wide ranging, 
`extensive and would be unduly burdensome to produce.   

`If you believe that additional discovery from Demonware is warranted, kindly explain the basis 
`of the request, including by identifying what specific accused functionality is at issue and what 
`claim elements are supposedly implicated by Demonware code.  If you can provide this 
`information, I can confer with my client about the feasibility of providing additional discovery 
`and whether there is any need to update any disclosures. Activision is certainly willing to 
`continue to produce discovery in this case, including as to Demonware, provided that the 
`plaintiff can meet its burden to establish relevance, need and proportionality.

`Acceleration Bay requested in its January 25, 2016 letter and during our meet and confer last week that
`Activision confirm that it will (1) promptly update its ESI Disclosures and/or Initial Disclosures to confirm that
`Demonware provides multiplayer and networking functionality used in the accused products, such as the Call of
`Duty games, (2) agree to produce relevant documents and to make available for inspection relevant source code
`held by its subsidiary Demonware (to the extent not included in the source code made available for inspection
`by Activision), and (3) provide technical core production from Demonware well in advance of the due date for
`Acceleration Bay’s infringement contentions.

`If Activision does not confirm that it will do so by close of business on February 4, 2016, we will seek relief
`from the Court.
