`Pharmaceuticals Inc. and Cipla Ltd. (collectively “Plaintiffs”) and Defendants Apotex Inc. and

`Apotex Corp. (collectively “Defendants”), pursuant to Federal Rule of Civil Procedure 15(a)(2),

`that Plaintiffs may file an amended complaint, styled as the First Amended Complaint, in the
`
`form attached hereto. By agreeing to Plaintiffs’ filing of its amended complaint, Defendants do

`not agree to any of the allegations therein, and Defendants reserve the right to respond to the

`amended complaint pursuant to the Federal Rules.
