`Plaintiffs claim for infringement of U.S. Patent No. 8,476,010 set forth in the Complaint (D.I. 1)

`filed November 26, 2014, be dismissed with prejudice and the Parties shall each bear their own

`costs, expenses, and attorneys' fees.
