`WHEREAS, Plaintiff Elm 3DS Innovations, LLC ("Plaintiff') petitioned the Court of

`Appeals for the Federal Circuit for rehearing on a claim term at issue in these actions;
`
`WHEREAS, Defendants Micron Technology, Inc., Micron Semiconductor Products, Inc.,
`
`Micron Consumer Products Group,
`
`Inc., Samsung Electronics Co., Ltd., Samsung
`
`Semiconductor, Inc., Samsung Electronics America, Inc., Samsung Austin Semiconductors,
`
`LLC, SK Hynix Inc., SK Hynix America Inc., Hynix Semiconductor Manufacturing America
`
`Inc., and SK Hynix Memory Solutions Inc. ("Defendants") requested that the Plaintiff agree to

`postpone the claim construction briefing schedule and hearing until a decision on the petition for

`rehearing is issued by the Court of Appeals for the Federal Circuit;
