`WHEREAS the above-captioned cases1 were stayed pending appeals of the Patent
`
`Office’s final decisions in inter partes review Case Nos. IPR2015-00158, IPR2015-00159,
`
`and IPR2015-00163 (“the IPRs”);
`
`WHEREAS those appeals have been dismissed by stipulation;
`
`WHEREAS the following claims of U.S. Patent No. 7,296,121 (“the ’121 Patent”)
`
`were found unpatentable by the Patent Office in the IPRs: 1-6, 8, 15-25;
`
`WHEREAS the following claims of the ’121 Patent were not found unpatentable in the
`
`IPRs: 7, 9-14;
`
`

`01799-GMS (D. Del.), which will be addressed in a separate filing.

`WHEREAS the following claims of the ’121 Patent were identified in Plaintiff’s
`
`Initial Identification of Asserted Claims and Accused Products: 1-3, 8, 11-12; 14-25;
`
`WHEREAS the Court’s August 23, 2016 Order provided that “after a judgment or
`
`dismissal has been filed in all three of the appeals [of the IPRs] the parties shall meet and
`
`confer . . . and submit a stipulation or joint statement”;
`
`IT IS HEREBY STIPULATED AND AGREED by the undersigned counsel for the
`
`parties Plaintiff Memory Integrity, LLC and the undersigned counsel for Defendants, subject
`
`to approval by the Court, THAT:
`
`1) Upon entry of this Order, the stay in the above-captioned cases shall be LIFTED;
`
`2) The parties shall submit a proposed revised scheduling order within thirty (30)
`
`days from the entry of this Order; and
`
`3) The parties request that the Court thereafter, at its discretion, enter a case schedule
`
`or set a scheduling teleconference.
