`Wright Medical Group, Inc. and Wright Medical Technology, Inc. (“Wright Medical”) provide
`
`the following status update.
`
`On April 7, 2014, the Court stayed the above-captioned cases in view of inter partes
`
`review (“IPR”) petitions filed with the Patent Trial and Appeal Board (“PTAB”) for several of
`
`the asserted patents. (D.I. 62, 12-1109; D.I. 45, 12-1107; D.I. 43, 12-1110.) The PTAB has
`
`instituted four IPR proceedings relating to U.S. Patent Nos. 7,806,896 (the “’896 patent”) and
`
`7,837,736 (the “’736 patent”); terminated three proceedings relating to U.S. Patent Nos.
`
`7,749,229 (the “’229 patent”), 6,702,821 (the “’821 patent”), and 8,133,229 (the “’3229 patent”);
`
`and declined to institute any proceedings relating to U.S. Patent No. 7,959,635 (the “’635
`
`patent”). The PTAB’s decisions on whether to institute two pending IPR petitions relating to the
`
`’896 patent and ’736 patent are expected on or before December 12, 2014.
`
`Thus, in total, six IPR proceedings relating to two patents are pending before PTAB and
`
`are in the following posture:
`
`Wright Medical
`
`Wright Medical’s IPR (No. IPR2014-00354) concerning certain claims of the “’896
`
`patent has been joined with Smith & Nephew’s IPR (No. IPR2013-00629). The patent owner,
`
`Bonutti Skeletal Innovations, LLC (“Bonutti”), disclaimed claim 40, and the validity of claim 1
`
`remains pending under Smith & Nephew’s case number. Oral argument in IPR2013-00629 is
`
`scheduled for 1:00 p.m. E.T. on October 27, 2014. Absent an extension for good cause shown
`
`(of up to six months, 35 U.S.C. § 316(a)(11); 37 C.F.R. § 42.100(c)), the PTAB’s deadline for
`
`rendering a decision concerning the validity of claim 1 is February 28, 2015. See 35 U.S.C. §
`
`316(a)(11).

`Zimmer
`
`Zimmer filed with the PTAB three petitions seeking IPR of three patents Bonutti has
`
`asserted against Zimmer and others. The patents in question—the ’896 patent, the ’736 patent,
`
`and the ’635 patent—are all directed to knee implants. Zimmer has filed a total of five IPR
`
`petitions related to these patents, two of which were filed after the Court’s stay order. As
`
`discussed below, four of those petitions relating to the ’896 patent and ’736 patents remain
`
`pending before the PTAB, while the PTAB has declined to institute IPR proceedings on the ’635
`
`patent.
`
`With respect to the ’896 patent, Zimmer sought review of claims 40-47 in IPR No.
`
`IPR2014-00321. On June 2, 2014, the PTAB instituted review of all but one of those eight
`
`claims, claim 43. Subsequently, Bonutti formally disclaimed claims 40, 41, and 44-47 pursuant
`
`to 37 C.F.R. § 1.321(a), leaving claim 42 in the pending IPR. Zimmer’s reply in support of its
`
`IPR petition is due on October 31, 2014. Absent an extension for good cause shown (of up to six
`
`months, 35 U.S.C. § 316(a)(11); 37 C.F.R. § 42.100(c)), the PTAB’s deadline for rendering a
`
`decision in IPR2014-00321 is June 2, 2015. See 35 U.S.C. § 316(a)(11). On June 30, 2014,
`
`Zimmer filed IPR No. IPR2014-01080, challenging claim 43 of the ’896 patent, along with a
`
`motion, pursuant to 37 C.F.R. § 42.122(b), seeking to join IPR2014-01080 with IPR2014-00321.
`
`IPR2014-01080 is pending but has not yet been instituted and no scheduling order has been
`
`entered.
`
`With respect to the ’736 patent, Zimmer sought review of claims 15-28 and 31-36, in IPR
`
`No. IPR2014-00191. On June 2, 2014, the PTAB instituted review of all but three of those 20
`
`claims, claims 23-25. Subsequently, Bonutti formally disclaimed claims 15-20 and 26-28
`
`pursuant to 37 C.F.R. § 1.321(a), leaving claims 21, 22, and 31-36 in the IPR, which remains
`

`pending. On October 11, 2014, Zimmer plans to take the deposition of Bonutti’s declarant, Dr.
`
`Scott D. Schoifet. Zimmer’s reply in support of its IPR petition is due on October 31, 2014.
`
`Absent an extension for good cause shown (of up to six months, 35 U.S.C. § 316(a)(11); 37
`
`C.F.R. § 42.100(c)), the PTAB’s deadline for rendering a decision in IPR2014-00321 is June 2,
`
`2015. See 35 U.S.C. § 316(a)(11). On June 30, 2014, Zimmer filed IPR No. IPR2014-01078,
`
`challenging claims 23-25 of the ’736 patent, along with a motion, pursuant to 37 C.F.R. §
`
`42.122(b), seeking to join IPR2014-01078 with IPR2014-00191. IPR2014-01078 is pending but
`
`has not yet been instituted and no scheduling order has been entered.
`
`With respect to the ’635 patent, Zimmer sought review of claims 1, 7, 8, 11, 12, 15, 16,
`
`and 30-39 in IPR No. IPR2014-00311. On June 4, 2014, the PTAB denied review on all claims.
`
`No claim from the ’635 patent remains subject to IPR.
`
