The Court conducted a hearing today on the Petitions for Action on Conditions of Pretrial Release docketed at ECF Nos. 35 and 36. For the reasons stated on the record, the Court finds that (a) there is clear and convincing evidence that Mr. Feliciano has violated his conditions of release; and (b) Mr. Feliciano is unlikely to abide by any condition or combination of conditions of release. Accordingly, the Court enters this order revoking his release pursuant to 18 U.S.C. 3148(b). Mr. Feliciano is remanded to the custody of the Attorney General or to the Attorney General's designated representative for confinement in a corrections facility separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. He must be afforded a reasonable opportunity for private consultation with defense counsel.
