`Plaintiff Dassault Systemes SolidWorks Corporation (“Plaintiff”) filed its
`Amended Complaint on August 25, 2023. (Doc. No. 9.) The Amended Complaint
`added two new defendants: Sean Ferguson (“Ferguson”) and Leonid Boris Volfson
`(“Volfson”). Defendants, including Volfson and Ferguson, filed an Answer to the
`Amended Complaint, asserting specific denials and affirmative defenses. (Doc. No.
`17.) Defendants have denied all copyright infringement of the SolidWorks software.

`The Scheduling Order Regulating Discovery and Other Pretrial Proceedings

`was entered on December 7, 2023. (Doc. No. 25.)
`The parties are currently engaged in extensive discovery. Defendants’
`discovery includes seeking files and documents regarding Plaintiff’s so-called
`“monitoring technology.” This monitoring technology is the cornerstone of Plaintiff’s
`Amended Complaint and now its Second Amended Complaint. See e.g., Second
`Amended Complaint, paragraphs 26, 27, 42, 43, 44, 50, 54, 56, 58, 64, 65, 67, 69, 70,
`76, 78, 84, 88, 95, 98, 100, 101, 102, 110, 111, 112, 115, 119, 131, 132 and others.
`Defendants have requested that the monitoring technology be produced to Defendants
`and all reports and data pertaining to the allegations of the Amended Complaint.
`Defendants contend this discovery is critical to its defenses and will confirm errors
`and false information in specific allegations Plaintiff made to support its claims for
`copyright infringement. To date, Plaintiff has failed to produce the monitoring
`technology and associated reports and data. Defendants will continue to seek the
`reports and data through discovery. The parties have a further status conference
`scheduled for April 5, 2024, before Magistrate Judge Daniel E. Butcher. (Doc. No.
`30.)
`
`Plaintiff now seeks to add two new parties as defendants: Premier Optical
`Technologies LLC and Christopher Thomas. Defendants recognize the great liberality
`applied in connection with allowing leave to amend pleadings under Rule 15(a) of the
`Federal Rules of Civil Procedure. Defendants do not oppose Plaintiff’s motion for
`leave but reserve all rights to file an answer or other responsive pleading to the Second
`Amended Complaint as appropriate and to continue to engage in discovery, including
`without limitation, discovery regarding Plaintiffs’ monitoring technology and the
`alleged basis for all of Plaintiff’s claims.
