`In addition to the Pattern Instructions, the government requests that the court give
`the following instructions:

`The defendant is charged in Counts 6 through 10 with electronic mail fraud, in violation
`of Section 1037(a)(5) of Title 18 of the United States Code. For the defendant to be
`found guilty of that charge, the government must prove each of the following elements
`beyond a reasonable doubt:
`
`1. The defendant knowingly falsely represented himself to be the registrant or the
`legitimate successor in interest to the registrant of five or more Internet Protocol
`addresses;
`
`2. The defendant intentionally initiated the transmission of multiple commercial
`electronic mail messages from those Internet Protocol addresses;
`
`3. The volume of the electronic mail messages transmitted in furtherance of the
`offense exceeded 2,500 during any 24-hour period, 25,000 during any 30-day
`period or 250,000 during any 1-year period; and
`
`4. The electronic mail messages were transmitted in or affecting interstate commerce.

`The term “multiple,” when used with respect to commercial electronic mail messages, is
`defined as more than 100 electronic mail messages during a 24-hour period, more than
`1,000 electronic mail messages during a 30-day period, or more than 10,000 electronic mail
`messages during a 1-year period.

`The term “commercial electronic mail message” means any electronic mail message the
`primary purpose of which is the commercial advertisement or promotion of a commercial
`product or service (including content on an Internet website operated for a commercial
`purpose).

`The term “transactional or relationship message,” when used with respect to a commercial
`electronic mail message, means an electronic mail message the primary purpose of which
`is:
`
`(1) to facilitate, complete, or confirm a commercial transaction that the recipient has
`previously agreed to enter into with the sender;
`(2) to provide warranty information, product recall information, or safety or security
`information with respect to a commercial product or service used or purchased by
`the recipient;
`(3) to provide (a) notification concerning a change in the terms or features of,
`(b) notification of a change in the recipient’s standing or status with respect to; or (c) at
`regular periodic intervals, account balance information or other type of account statement
`with respect to, a subscription, membership, account, loan, or comparable ongoing
`commercial relationship involving the ongoing purchase or use by the recipient of products
`or services offered by the sender;
`(4) to provide information directly related to an employment relationship or related
`benefit plan in which the recipient is currently involved, participating, or enrolled; or
`(5) to deliver goods or services, including product updates or upgrades, that
`the recipient is entitled to receive under the terms of a transaction that the recipient has
`previously agreed to enter into with the sender.

`The term “routine conveyance,” when used with respect to a commercial electronic mail
`message, means the transmission, routing, relaying, handling, or storing, through an
`automatic technical process, of an electronic mail message for which another person has
`identified the recipients or provided the recipient addresses.
