`I, Philip Ou, hereby declare as follows:

`I am a partner with the law firm Paul Hastings LLP, counsel for the Plaintiff
`Applied Materials, Inc. (“Applied”) in the above captioned matter. I have personal knowledge of
`the facts contained in the declaration and, if called upon to do so, I could and would testify
`competently to the matters set forth herein.
`2.
`I submit this declaration in support of Applied’s Motion To Shorten Time For An
`Earlier Hearing Or For Determination On The Papers On Applied’s Motion To Strike.
`3.
`On February 18, 2022 counsel for Applied confirmed with counsel for Demaray
`that Demaray was available for hearing on June 30, 2022, but did not oppose Applied’s request
`for an earlier hearing if available on the Court’s schedule.
`4.
`The parties have previously stipulated to time modifications and this Court has
`granted the parties’ requested time modifications. See Dkt. Nos. 25, 32, 39, 88, 112. The
`requested time modification will not otherwise impact the schedule for the case.
