`
`
`
`
`
`On November 16, 2023, the Court heard oral argument on Amazon.com, Inc., Amazon
`
`Web Services, Inc., and Twitch Interactive, Inc.’s (collectively, “Amazon”) Motion for Further
`
`Supplemental Fees (the “Motion”). See ECF No. 906.1 On November 21, 2023, pursuant to the
`
`Court’s request during the hearing, PersonalWeb Technologies, LLC (“PersonalWeb”) filed a
`
`supplemental opposition to the Motion in which it proposed reductions to Amazon’s requested
`
`attorneys’ fees based on time Amazon’s attorneys billed for work performed in pursuit of
`
`Amazon’s alter ego theory against PersonalWeb’s alleged alter egos. See Suppl. Opp’n, ECF No.

`Case 5:18-md-02834-BLF Document 912 Filed 11/22/23 Page 2 of 2
`
`
`
`910. PersonalWeb concurrently submitted a supporting Declaration of Patrick Emerson
`
`McCormick, in which Mr. McCormick described initial discussions between the parties regarding
`
`a potential stipulated fee reduction. See McCormick Decl. ¶¶ 4–16, ECF No. 911. Mr.
`
`McCormick stated that PersonalWeb “wants to continue discussions to potentially reach a
`
`mutually agreeable dollar amount following this filing.” Id. ¶ 17. Amazon’s response to
`
`PersonalWeb’s supplemental opposition is currently due on November 28, 2023.
`
`Based on the representations in the McCormick Declaration, it appears that the parties
`
`would benefit from additional time to discuss resolution of the issue of a potential stipulated
`
`reduction in Amazon’s request for attorneys’ fees related to work performed in pursuit of an alter
`
`ego theory. Accordingly, the Court hereby ORDERS that the deadlines for both (1) the parties’
`
`filing of a stipulated fee reduction and (2) Amazon’s response to PersonalWeb’s supplemental
`
`opposition are extended to December 1, 2023. If the parties reach an agreement on the alter ego
`
`fee issue and file a related stipulation on or before December 1, 2023, Amazon need not also file a
`
`response to PersonalWeb’s supplemental opposition.
`
`
`
`IT IS SO ORDERED.
