`
`WHEREAS, Robert M. Charles, Jr. and Patrick Emerson McCormick of Lewis Roca
`Rothgerber Christie LLP (“Lewis Roca”) have agreed to represent Plaintiff PersonalWeb
`Technologies, LLC (“PersonalWeb”) regarding post-judgment discovery, potential remand of the
`fee award from the Federal Circuit, and collection efforts against PersonalWeb,
`WHEREAS, the Parties agree that such scope of representation encompasses the
`reasonably foreseeable tasks in these cases concerning PersonalWeb’s defense against Defendants
`Amazon.com, Inc. and Twitch Interactive, Inc.’s (“Amazon”) enforcement of their judgment
`against PersonalWeb;
`WHEREAS, Lewis Roca represents that it is not authorized to, and will not, represent
`PersonalWeb concerning any assertion of claims of patent infringement or related affirmative
`defenses; and
`WHEREAS, the Parties have pending discovery disputes, including whether PersonalWeb
`must search its records in the possession of its former counsel Stubbs Alderton Markiles LLP in
`responding to the Court’s discovery orders, and whether the Court should order any relief directly
`against Stubbs Alderton Markiles, neither of which will be affected by the current stipulation (i.e.,
`PersonalWeb and Amazon will not be deemed to have waived any right to relief by entering into
`this Stipulation);
`THE PARTIES THEREFORE AGREE THAT:
`PersonalWeb has substantially complied with the Court’s past orders (Dkts. 760 & 769)
`such that Stubbs Alderton Markiles should be permitted to withdraw as counsel of record for
`PersonalWeb, with Lewis Roca continuing on as counsel of record according to the limitations set
`forth above and stated in its Amended Notice of Appearance, Dkt. 770; and
`The case management conference currently set for September 29, 2022 at the Parties’
`request, per Dkt. 774, can be vacated.
