`Pursuant to Civil L.R. 6-1(a), the undersigned parties (the “parties”) hereby stipulate and recite as
`
`follows:
`
`WHEREAS, on August 22, 2018, the Court entered an order reassigning this case and
`
`consolidating it into the multidistrict litigation In re PersonalWeb Technologies, LLC et al., Patent
`
`Litigation, Case No. 18-md-02834-BLF (the “MDL”) for pretrial purposes and advising that a Preliminary
`
`Case Management Conference is scheduled for September 20, 2018 at 1:30 pm (MDL, Dkt. No. 42);
`
`WHEREAS, on July 13, 2018, the Court issued an Order granting a joint stipulation continuing
`
`the Preliminary Case Management Conference in the MDL (MDL, Dkt. No. 26, the “Continued CMC
`
`Order”);
`
`WHEREAS, as part of the Continued CMC Order, the Court permitted the parties in the MDL to
`
`file a stipulation extending any defendant’s deadline to respond to the complaint up to a date that is two
`
`weeks after the Preliminary Case Management Conference without obtaining a court order (Id.);
`
`WHEREAS, on July 18, 2018, the Court issued an Order setting the Preliminary Case Management
`
`Conference for September 20, 2018 (MDL, Dkt. No. 28, the “Reset CMC Order”);
`
`WHEREAS, two weeks after the MDL’s September 20, 2018 Preliminary Case Management
`
`Conference is October 4, 2018;
`
`WHEREAS, pursuant to a stipulation that was then made part of the Continued CMC Order (Dkt.
`
`No. 26) and the Reset CMC Order (Dkt. No. 28), all cases that are part of the MDL are stayed until
`
`September 20, 2018;
`
`WHEREAS, Shopify (USA) Inc.’s current response deadline is August 24, 2018, and Shopify
`
`(USA) Inc. has requested, and PersonalWeb Technologies, LLC and Level 3 Communications, LLC
`
`(collectively, “PersonalWeb”) have agreed, to an extension of time up to and including October 4, 2018
`
`for Shopify (USA) Inc. to file an answer or otherwise respond to PersonalWeb’s Complaint;
`
`WHEREAS Shopify (USA) Inc. preserves all rights and defenses;
`
`THE PARTIES HEREBY STIPULATE and jointly request that Shopify (USA) Inc. shall have up
`
`to and including October 4, 2018 to submit an answer or otherwise respond to the Complaint.
