`FanDuel Inc. on Thursday became the latest company hit with a
`cloud computing patent suit by software developer
`PersonalWeb Technologies LLC, which in recent days has sued
`dozens of others, including Airbnb Inc., Blue Apron Inc., Venmo
`and Reddit.
`
`The developer’s New York federal lawsuit alleges that the way
`the fantasy sports giant populates its website in real time
`infringes five different PersonalWeb patents related to cloud
`computing. Its patented technology, PersonalWeb alleges,
`allows internet users to have the most up-to-date data at their
`fingertips. That technology is being improperly co-opted by
`FanDuel, the developer claims.
`
`The suit comes after the developer in the past week filed nearly
`four dozen similar suits in California and New York federal
`courts.
`
`Michael A. Sherman of IP Law Group LLP said that the string of
`suits comes after a year of due diligence into alleged
`widespread infringement.
`
`“We spent the past [year] carefully studying our technology and
`the open source infringement and my client is going to enforce
`its statutorily granted rights to enforce its patents,” Sherman

`Level 3 Communications LLC is additionally named as a plaintiff
`in the suit, but the complaint stipulates that it has joined the suit
`as a contractual obligation and does not bring its own individual
`claims.
`
`This week’s actions are not the first time the company has
`lobbed such suits. In recent years, the developer has sued a
`number of internet and technology giants, including IBM Corp.,
`Facebook Inc., Apple Inc., Google LLC, Yahoo! Inc. and
`Microsoft Corp.
`
`IBM struck a confidential deal with the developer in August just
`as trial was about to begin in that case.
`
`The suit against FanDuel alleges infringement of U.S. Patent
`Nos. 5,978,791; 6,928,442; 7,802,310; 7,945,544; and
`8,099,420.
`
`Representatives for FanDuel declined to comment on Friday.
`
