`Case 5:18-md-02834-BLF Document 421 Filed 04/30/19 Page 2 of 2
`
`
`
`Pursuant to Civil Local Rule 7-11 and the Section C.5 of the Standing Order regarding Civil
`
`Cases of this Court, Defendant Cars.com respectfully moves the Court for an order permitting its
`
`counsel at the Marshall, Gerstein & Borun LLP, Benjamin T. Horton and John J. Lucas, to appear by
`
`telephone on Cars.com’s behalf at the Claim Construction Tutorial scheduled for May 2, 2019, at
`
`2:00 p.m., before the Honorable Judge Beth L. Freeman.
`
`Mr. Horton and Mr. Lucas are located in the Chicago office of the Marshall Gerstein firm. It
`
`would be costly for Cars.com to have them travel to appear in person as it would take approximately
`
`13 to 18 hours of travel time and require an overnight stay in California. Cars.com’s case is one of
`
`the numerous customer cases currently stayed while the Court proceeds with the Amazon DJ action.

`

`
`In view of the limited involvement required of Cars.com’s counsel at the Claim Construction
`
`11
`
`Tutorial and the significant time and expenses involved for an in-person appearance, Cars.com
`
`12
`
`respectively requests the Court to permit its counsel Mr. Horton and Mr. Lucas to participate
`
`13
`
`telephonically in the Conference
`
`Counsel for Plaintiffs does not object to this request.
