`I, Christopher T. McWhinney, hereby declare as follows:

`I am an attorney admitted to practice before this Court pro hac vice and a

`partner of Sullivan & Worcester LLP, counsel of record for Defendant Vice Media, LLC in the
`
`above captioned cases. I have personal knowledge of the matters stated below and, if called as a

`witness, I could competently testify thereto.

`in the Washington, DC area.

`As one of the customer cases currently stayed while the Court proceeds with

`the Amazon DJ action, Vice Media, LLC anticipates limited involvement required of its counsel
`
`at the Kessler Motion Hearing and Further Case Management Conference scheduled to be held
`
`February 28, 2019 at 1:30 p.m.
`

`Counsel for Vice Media, LLC has inquired whether Plaintiffs object to this

`request and have been informed that Plaintiffs do not object.
