`I have communicated with my client and we are prepared to accept the new language you have inserted on the 
`condition that you agree we have until Friday, June 6, to file the stipulation and order of dismissal with the Court.  For 
`business reasons other than this case, my client needs that timing.  This email shall constitute our agreement today to 
`the terms of the dismissal as you have expressed them.  We agree that no further action by any party in connection with 
`this case shall occur,  that no party will be serving expert reports on Monday, and that our office will file the stipulation 
`of dismissal and order in the form you have proposed on or before Friday, June 6. 

`Please let me know ASAP if you have any problem with any of the above.  Thanks.
