`In accordance with the Court’s instructions at the Further Case Management Conference
`
`on November 2, 2018, Amazon.com, Inc. and Amazon Web Services, Inc. (collectively,
`
`“Amazon”) and PersonalWeb Technologies, LLC and Level 3 Communications, LLC
`
`(collectively, “PersonalWeb”) agree that PersonalWeb’s case against Twitch Interactive, Inc.
`
`(“Twitch”) (Case No. 5:18-cv-05619-BLF) should go forward with Amazon’s declaratory
`
`judgment action.
`
`PersonalWeb proposes that one additional customer case (PersonalWeb et al. v.
`
`Kongregate, Inc., Case No. 5:18-cv-04625-BLF) go forward with the Amazon and Twitch cases.
`
`Amazon does not agree that any additional customer case should go forward. As directed by the
`
`Court, the parties will submit one-page statements in support of their positions on Friday,
`
`November 9, 2018.
