`
`Defendant SonicWall, Inc. (“SonicWall”), pursuant to Federal Rule of Civil Procedure
`26(a)(1)(A) and the Joint Case Management Statement (Dkt. 61), hereby makes the following
`supplemental initial disclosures.
`
`RESERVATION OF RIGHTS
`These disclosures are based upon information reasonably available to SonicWall as
`1.
`of the date that these disclosures were prepared. Accordingly, SonicWall reserves the right to
`supplement the information provided herein if additional information becomes known as its
`investigation of the facts continues.
`These disclosures are based upon the accused products identified in Plaintiff’s
`2.
`Complaint for Patent Infringement (“Complaint”). Plaintiff’s Complaint, however, provides very
`little information regarding the specific components and functionality within the accused products
`that could possibly infringe the Patents-in-Suit. Accordingly, SonicWall’s disclosures are
`necessarily limited to what it understands to be the accused products and the accused functionality
`within those products. To the extent Plaintiff is permitted to identify additional accused products or
`clarifies the particular aspects of the accused products at issue in this case, SonicWall reserves the
`right to amend these disclosures.
`These disclosures are not intended to and do not waive any objections that
`3.
`SonicWall may later have to any discovery in this action. SonicWall expressly reserves any and all
`objections that it has, had, or may have including, but not limited to, objections based on relevance,
`attorney client privilege, attorney work-product privilege, the common interest privilege, or any
`other applicable privilege or protection; undue burden or harassment; immateriality; overbreadth;
`and proportionality.
`SonicWall expressly reserves the right to clarify, amend, modify or supplement the
`4.
`information contained in these disclosures in the event that it obtains additional information, to the
`extent required by the Federal Rules of Civil Procedure, or by an order of the Court.

`SonicWall expressly reserves the right to identify or call as witnesses individuals in
`5.
`addition to those identified herein if they discover that such individuals have or might have
`knowledge of matters relevant to this action.
`Any and all of these disclosures are made subject to and without limiting any of the
`6.
`foregoing reservations of rights.
`
`INITIAL DISCLOSURES
`
`(i) The name and, if known, the address and telephone number of each individual likely to
`have discoverable information—along with the subjects of that information—that the
`disclosing party may use to support its claims or defenses, unless the use would be solely for
`impeachment.
`
`SonicWall has and will continue to identify persons with knowledge regarding the accused
`products and the other relevant issues in this case. SonicWall will supplement this list to the extent
`necessary when its investigation is completed. SonicWall’s investigation to date has been
`performed without the benefit of Plaintiff’s infringement contentions, including an identification of
`components of SonicWall’s products that correspond to each and every limitation of each asserted
`claim. As SonicWall’s investigation progresses and when Plaintiff provides rules-compliant
`infringement contentions, SonicWall will supplement these disclosures as necessary with the
`identity of SonicWall’s employees who have knowledge of relevant facts.
`SonicWall further reserves the right to supplement and/or amend this list based on further
`investigation, analysis, and discovery, to the extent additional disclosures are not mooted or made
`redundant by future discovery requests. SonicWall’s employees who are listed as witnesses should
`be contacted only through SonicWall’s counsel. SonicWall further discloses and reserves its right
`to rely on witnesses identified in other cases concerning the Patents-in-Suit who would have
`knowledge relevant to the liability and damages issues in this case, including all of Plaintiff’s
`experts in those cases. SonicWall’s present witness list, however, is not intended to disclose or
`foreclose the identification of any other expert witnesses who will be disclosed in accordance with
`the Court’s Joint Case Management Statement in this case.
