`QUALYS’S INVALIDITY CONTENTIONS
`Defendant Qualys, Inc. (“Qualys”) provides its L.R. 3-3 and 3-4 disclosures to Plaintiff
`Finjan, Inc. (“Finjan”) with respect to the asserted claims identified by Finjan in its Initial
`Disclosure of Asserted Claims and Infringement Contentions1 served on April 19, 2019
`(“Asserted Claims”). The Asserted Claims are as follows:
`
`• Claims 1-9, 11, 15-17, 21-23, 32, and 41-44 of U.S. Patent No. 6,154,844 (“the ’844
`Patent”);
`
`• Claims 1, 6-7, 9-11, 13-15, 23, 26 and 32-33 of U.S. Patent No. 6,965,968 (“the ’968
`Patent”);
`
`• Claims 1-2, 14-15 and 17 of U.S. Patent No. 7,418,731 (“the ’731 Patent”);
`• Claims 1-2, 5-15, and 17-25 of U.S. Patent No. 7,975,305 (“the ’305 Patent”);2
`• Claims 1-2 and 4 of U.S. Patent No. 8,141,154 (“the ’154 Patent”); and
`• Claims 1, 3-8, 22-23, 29, and 35 of U.S. Patent No. 8,225,408 (“the ’408 Patent”).
`• Claims 10-16 and 18 of U.S. Patent No. 8,677,494 (“the ’494 Patent”);
`With respect to each Asserted Claim, Qualys identifies in compliance with Patent L.R. 3-
`3: (a) the identity of each item of prior art that allegedly anticipates each asserted claim or
`renders it obvious; (b) whether each item of prior art anticipates each asserted claim or renders it
`obvious; (c) a chart identifying specifically where and how in each alleged item of prior art each
`limitation of each asserted claim is found; and (d) any grounds of invalidity under 35 U.S.C.
`§101, indefiniteness under 35 U.S.C. § 112(2), or enablement or written description 35 U.S.C. §
`112(1) of any of the Asserted Claims. This identification is based on information presently
`known to Qualys and is subject to its ongoing investigation. Qualys reserves the right to

`supplement and/or amend these Invalidity Contentions in accordance with the rules and orders of
`this Court.
`Qualys makes these disclosures without waiving or contradicting any position that
`Finjan’s Disclosure of Infringement Contentions is deficient for failing to comply with the Patent
`Local Rules and applicable case law.
`I.
`GENERAL RESERVATIONS
`The following contentions are subject to the reservations stated above and subject to
`amendment pursuant to at least Patent L.R. 3-6, Rule 26(e) of the Federal Rules of Civil
`Procedure to the extent appropriate in light of, for example, ongoing investigation and discovery
`regarding the defenses asserted by Qualys, any Court-ordered claim construction related to any
`asserted claim, and the review and analysis of expert discovery.
`The information and documents that Qualys produces are provisional and subject to
`further revision as follows: Qualys expressly reserves the right to amend the disclosures and
`document production herein should Finjan provide any information that it failed to provide in its
`Infringement Contentions, has not produced in discovery, and/or should Finjan amend its
`Infringement Contentions. Further, because discovery is not yet complete and because Qualys’s
`search for, and analysis of, relevant prior art is ongoing, Qualys reserves the right to amend the
`information provided herein, including identifying, charting, and relying on additional prior art,
`should Qualys’s further search and analysis yield additional information or references (or based
`on information and documents Finjan produced in discovery), consistent with the Local Patent
`Rules for the Northern District of California and the Federal Rules of Civil Procedure.
`Moreover, Qualys reserves the right to revise any contentions concerning the invalidity of the
`Asserted Claims, which may change depending upon any findings as to the priority or invention
`date of the Asserted Claims, and/or positions that Finjan or expert witness(es) may take
`concerning claim construction, infringement, and/or invalidity issues.
`Prior art not included in these contentions, whether known or not known to Qualys, may
`become relevant. In particular, Qualys is currently unaware of the extent, if any, to which Finjan
`will contend that limitations of the Asserted Claims are not disclosed in the prior art identified by

`Qualys. To the extent that such an issue arises, Qualys reserves the right to identify other prior
`art that would render obvious the allegedly missing limitation(s) of the disclosed system or
`method.
`To the extent the following contentions reflect constructions of claim limitations
`consistent with or implicit in Finjan’s Infringement Contentions, no inference is intended nor
`should any be drawn that Qualys agrees with Finjan’s interpretation or understanding of any
`claim limitation accused of being present literally or under the doctrine of equivalents, and
`Qualys expressly reserves the right to contest Finjan’s understanding or interpretation of such
`claim limitations. Qualys offers the following invalidity contentions in response to Finjan’s
`Infringement Contentions. Qualys offers the following invalidity contentions without prejudice
`as to (a) any position Qualys may ultimately take regarding any claim construction issues, and
`(b) Qualys’s understanding or interpretation of any claim limitation accused of being present
`literally or under the doctrine of equivalents.
`Qualys further intends to rely on inventor admissions concerning the scope of the prior
`art relevant to the asserted patents found in, inter alia: the patent prosecution history
`corresponding to each of the asserted patents and any patents or patent applications related to the
`asserted patents; any deposition testimony of any named inventor on any of the asserted patents
`and any patents or patent applications related to the asserted patents in this action or any other
`action; and the papers filed and any evidence submitted by Finjan in connection with this action.
`Qualys’s claim charts in Exhibits A-G cite to particular teachings and disclosures of the
`prior art as applied to features of the Asserted Claims. However, persons having ordinary skill in
`the art generally may view an item of prior art in the context of other publications, literature,
`products, and understanding. As such, the cited portions are only examples, and Qualys reserves
`the right to rely on uncited portions of the prior art (including any information incorporated by
`reference); and on other publications, expert testimony, and other evidence as aids in
`understanding and interpreting the cited portions, as providing context thereto, and as additional
`evidence that the prior art discloses a claim limitation or an asserted claim as a whole. Qualys
`further reserves the right to rely on uncited portions of the prior art references (including any

`information incorporated by reference), other publications, and testimony (including expert
`testimony) to establish that an item of prior art discloses a claim limitation or an asserted claim
`as a whole, and to establish bases for combinations of certain items of prior art that render the
`Asserted Claims obvious. Where Qualys cites to a particular figure in prior art, the citation
`should be understood to encompass the caption and description of the figure and any text relating
`to or discussing the figure. Conversely, where Qualys cites to particular text referring to a
`figure, the citation should be understood to include the figure as well.
`The items of prior art disclosed in the claim charts in Exhibits A-G may disclose the
`limitations of the Asserted Claims explicitly and/or inherently, and they may be relied upon to
`show the state of the art in the relevant time frame. The suggested obviousness combinations are
`provided in the alternative to Qualys’s anticipation contentions and are not to be construed to
`suggest that any item of prior art included in the combinations is not by itself anticipatory.
`Qualys reserves the right to assert that the Asserted Claims are invalid under 35 U.S.C.
`§ 102(f) in the event that Qualys obtains evidence that the inventors named in any of the asserted
`patents did not invent (either alone or in conjunction with others) the subject matter claimed in
`the asserted patents. If Qualys obtains such evidence, it will provide the name of the person(s)
`from whom and the circumstances under which the invention or any part of it was derived.
`Qualys also reserves the right to challenge any of the claim terms herein under 35 U.S.C.
`§§ 101 and 112, including by arguing that they are patent-ineligible, indefinite, not supported by
`the written description, not enabled, or fail to disclose the best mode contemplated by the
`inventor(s). Accordingly, nothing stated herein shall be construed as a waiver of any argument
`available under 35 U.S.C. §§ 101, 102, and 112.
`Qualys reserves the right to modify, amend, or further supplement these contentions to
`show the invalidity of any additional claims that the Court may allow Plaintiff to later assert.
`Qualys further reserves the right to supplement its Patent L.R. 3-4 document production should it
`later find additional responsive documents.
`For example, Finjan has agreed to produce all prior art that has ever been asserted against
`the Asserted Patents in the past or present, but has not yet done so. Qualys reserves the right to

`supplement these invalidity contentions based on information Finjan later produces that is not
`presently in Qualys’s possession, custody, or control.
`II.
`PRIORITY DATE
`For each of the Asserted Claims, Plaintiff has failed to demonstrate any basis upon which
`the claims are entitled to a priority date earlier than the filing date of the applications. The
`priority dates of the Asserted Claims are no earlier than the filing dates of the respective patent
`applications at least because: any claim to earlier priority documents was not timely and properly
`claimed, there is no continuity of disclosure, there is insufficient disclosure in the earlier priority
`documents, and there is no specific claim of priority within the earlier priority documents; and
`any claim to an earlier date of conception is not sufficiently supported by evidence and was not
`adequately coupled with sufficient reduction to practice and diligence.
`For example, Finjan alleges that the claims of the ‘844 Patent are entitled to a priority
`date of November 8, 1996. However, the Court in Finjan, Inc. v. Blue Coat Systems, Inc. found
`that the claims of the ‘844 Patent are entitled to a priority date no earlier than December 22,
`1997. See Case No. 5:13-cv-03999-BLF (N.D. Cal.), Dkt. No. 486 at p. 7 (Nov. 20, 2015).
`Moreover, Finjan also alleges that the claims of the ‘731 Patent are entitled to a priority date of
`November 8, 1996. However, the Court in Finjan, Inc. v. Blue Coat Systems, Inc. found that the
`claims of the ‘731 Patent are entitled to a priority date of November 6, 1997. See id.at 9.
`III.
`PATENT L.R. 3-3(a): IDENTIFICATION OF PRIOR ART
`Patent L.R. 3-3(a) requires the following:
`The identity of each item of prior art that allegedly anticipates each asserted claim
`or renders it obvious. Each prior art patent shall be identified by its number,
`country of origin, and date of issue. Each prior art publication shall be identified by
`its title, date of publication, and where feasible, author and publisher. Each alleged
`sale or public use shall be identified by specifying the item offered for sale or
`publicly used or known, the date the offer or use took place or the information
`became known, and the identity of the person or entity which made the use or
`which made and received the offer, or the person or entity which made the
`information known or to whom it was made known. For pre-AIA claims, prior art
`under 35 U.S.C. § 102(f) shall be identified by providing the name of the person(s)
`from whom and the circumstances under which the invention or any part of it was
`derived. For pre-AIA claims, prior art under 35 U.S.C. § 102(g) shall be identified
`by providing the identities of the person(s) or entities involved in and the
`circumstances surrounding the making of the invention before the patent
`applicant(s).”

`Pursuant to Patent L.R. 3-3(a) and subject to Qualys’s reservation of rights in these Contentions,
`Qualys identifies each currently known item of prior art that it knows to either anticipate or
`render obvious one or more Asserted Claims in Tables 1-4 below:
`
`• Table 1 identifies each prior art patent by its number, country of origin, filing date, and
`issue date.
`
`• Table 2 identifies each prior art patent publication by its number, country of origin, filing
`date, and publication date.
`
`• Table 3 identifies each prior art publication by its title, publication date, and where
`feasible, author and publisher.
`
`• Tables 4 identifies prior art items, such as products or systems, for which Qualys believes
`qualify as prior art, and expects to receive additional documentation. Table 4 also
`identifies the prior art item offered for sale or publicly used or known in the “Prior Art
`Item” column, the date the offer or use took place or the information became known in
`the “Date” column, and the identity of the person or entity which made the use or which
`made and received the offer, or the person or entity which made the information known
`or to whom it was made known in the “Identity” column.
`Whether any item of prior art anticipates or renders obvious any asserted claim may depend upon
`claim construction. Discovery is ongoing, and Qualys’s prior art investigation and third-party
`discovery is therefore not yet complete. The tables of prior art provided herein are not exclusive,
`and Qualys’s production pursuant to Patent L.R. 3-4 and supplemental production may contain
`additional items of prior art that render one or more of the Asserted Claims invalid. Qualys
`reserves the right to rely on both the listed and unlisted items of prior art produced pursuant to
`Patent L.R. 3-4, as well as other prior art that may become known and/or relevant during the
`course of this action. Qualys reserves the right to present additional items of prior art under 35
`U.S.C. §§ 102 and 103 that are located during the course of discovery or further investigation.
`For example, Qualys expects to receive documents from third parties (either through informal
`requests or under subpoena) that are believed to have knowledge, documentation, or
`corroborating evidence concerning any prior art listed in Tables 1-4 and any additional prior art.

`Qualys further incorporates by reference all invalidity contentions and any supplemental or
`amended invalidity contentions served on Finjan by any defendant in other litigation (past,
`present/ongoing, or future), including the cases listed above. Qualys intends to rely upon any
`additional prior art references discussed or disclosed in any expert report on the invalidity of the
`patents-in-suit, in this action or any other litigation (past, present/ongoing, or future) and/or re-
`examination involving the patents-in- suit and any related patents. Qualys also intends to rely on
`references identified in the file histories of the patents-in-suit, any related applications or issued
`patents (e.g., continuations, continuations-in-part, divisional, foreign counterparts etc.), as well
`as any re-examinations, IPR, or reissue of the patents-in-suit or related patents. Qualys
`incorporates by reference those prior art references herein. Qualys has already requested such
