`I, Warren J. McCarty III, hereby declare as follows:
`1.
`I am an associate at the law firm of Caldwell Cassady Curry, P.C. in Dallas,
`
`Texas. I am admitted to practice in the State of Illinois and the State of Texas and have been
`admitted Pro Hac Vice in this matter. I submit this declaration based on personal knowledge and
`following a reasonable investigation. If called upon as a witness, I could and would competently
`testify to the truth of each statement herein.

`Before filing Windy City’s response to Facebook’s letter brief requesting a pre-
`filing conference (Dkt. 141), I personally reviewed the Court’s Standing Order in Civil Cases.
`3.
`I have also previously requested that all attorneys and staff working on the above-
`captioned case review and re-review all applicable standing orders and local rules, including the
`Court’s Standing Order in Civil Cases.

`I personally drafted Windy City’s response to Facebook’s letter brief requesting a
`pre-filing conference (Dkt. 141). In preparing this response, I studied the Court’s Standing Order
`in Civil Cases and coordinated with attorneys and staff at my firm to ensure compliance
`therewith.
`5.
`I did not intend to circumvent the Court’s Standing Order in Civil Cases in any
`way. In preparing and filing Windy City’s response, my colleagues and I believed that we were
`in compliance with the Court’s Standing Order in Civil Cases. Any failure to comply was
`entirely inadvertent.
`
`6.
`After receiving the Court’s Order to Show Cause (Dkt. 143), I discussed this
`matter with members of my firm, including Mr. Bradley Caldwell and staff working on this case.
`I also consulted with opposing counsel about this matter.
`7.
`I attest that I have reviewed the Court’s Standing Order in Civil Cases.
