`Pursuant to the Court’s July 8, 2022 Order staying this case (ECF No. 82) and the Court’s
`
`
`
`
`
`
`December 20, 2022 Order continuing the stay (ECF No. 84), Plaintiff Duolingo, Inc. (“Duolingo”)
`
`and Defendant Modern Font Applications LLC (“MFA”) respectfully submit this joint notice
`
`informing the Court of the Patent Trial and Appeal Board’s Final Written Decisions in the
`
`remaining IPR proceedings.
`
`Duolingo filed an action for Declaratory Judgment of Non-Infringement as to U.S. Patent
`
`No. 8,522,127 (the “’127 Patent”), U.S. Patent No. 9,886,421 (the “’421 Patent”), and U.S. Patent
`
`No. 9,892,093 (the “’093 Patent”) (collectively, the “Asserted Patents”). (ECF No. 1.) On April
`
`4, 2022, Duolingo filed three IPR petitions (Nos. 2022-00798, 2022-00799, and 2022-00800)
`
`challenging all claims of each of the Asserted Patents. In July 2022, the Court entered the parties’
`
`stipulation staying this case pending resolution of those IPR proceedings. (ECF No. 82.) In
`
`November 2022, the parties informed the Court that the Patent Trial and Appeal Board (“PTAB”)
`
`instituted IPRs for the ’093 Patent and ’421 Patent on all challenged claims, and denied institution
`
`for the ’127 Patent on all challenged claims. (ECF No. 83.) The parties also informed the Court
`
`that an ex parte re-examination of the ’127 Patent was pending before the PTAB. (Id.) The Court
`
`continued the stay pursuant to the parties’ stipulation. (ECF No. 84.)
`
`On November 16, 2023, the PTAB issued a Final Written Decision for the ’093 Patent
`
`finding all challenged claims unpatentable. (Ex. A (IPR2022-00800, Paper 77).) On November
`
`21, 2023, the PTAB issued a Final Written Decision for the ’421 Patent finding all challenged
`
`claims unpatentable. (Ex. B (IPR2022-00799, Paper 77).)
`
`On November 17, 2023, the PTAB issued a Decision on Appeal in the ex parte re-
`
`examination, affirming the Examiner’s final rejection of claims 1-7 and 26-28 of the ’127 Patent.
`
`(Ex. C (Ex Parte Clantech, Inc., No. 2023-002524).) The Decision on Appeal regarding the ’127
`
`Patent is not a final, appealable decision because it states, “This decision contains a new ground
`
`of rejection pursuant to 37 C.F.R. §41.50(b).” (Ex. C pp. 28-29.) The cited regulation, section
`
`41.50(b), requires the patent owner to decide within two months, whether to reopen prosecution
`
`or request rehearing from the PTAB. 37 C.F.R. §41.50(b). As such, the re-examination proceeding
`

`remains pending before the U.S. Patent and Trademark Office.
`
`MFA states that it is considering, but has not yet made a final decision, regarding its rights
`
`to appeal the PTAB’s Final Written Decisions regarding either the ‘093 patent or the ‘421 patent
`
`Under 35 U.S.C. §§141(c), 142 and 37 C.F.R. §90.3, MFA’s deadline for filing a notice of appeal
`
`is 63 days after the respective decisions. After that time, MFA anticipates that the parties will
`
`know which appeals have been filed and will have a better understanding of the status of the
`
`reexamination proceeding.
`
`Accordingly, the parties request that the court maintain the current stay and set the date for
`
`a renewed status report fourteen (14) days after MFA’s deadline for filing any notice of appeal for
`
`the ’421 Patent has expired (i.e., February 16, 2024). If MFA files any notice of appeal, the parties
`
`shall inform the Court whether parties agree to continue the stay during the appeals process.
