`I, Petr Kostka, declare as follows:
`1.
`I am a Software Engineering Manager at Apple Inc. (“Apple”). I submit this
`declaration based upon matters within my own personal knowledge. If called to testify, I could and
`would competently testify to the matters as set forth below.
`2.
`I was employed at a company called UPEK from April 2003 to August 2010. In
`September 2010, UPEK was acquired by a company called AuthenTec, Inc. After AuthenTec’s
`acquisition of UPEK, I continued working as an employee of AuthenTec, first as a Team Lead,
`then as a Software Engineering Manager, until Apple acquired AuthenTec in July 2012.
`3.
`After Apple’s acquisition of AuthenTec, I continued working as an AuthenTec
`employee and eventually became an Apple employee after a transition period following the
`acquisition.
`4.
`In my current role as a Software Engineering Manager at Apple, I am responsible
`for managing a team of engineers that are involved in Touch ID, Face ID, and Apple Pay features
`across all of Apple’s platforms.
`5.
`I have been involved in the development of Touch ID since 2012. Touch ID is a
`fingerprint identity sensor that can be used to verify the identity of a user on an Apple device based
`on the user’s fingerprint. As part of my role as a Software Engineering Manager, I am familiar
`with Apple’s product development processes and Apple’s treatment of its proprietary and
`confidential designs and technical information for the features used in its products.
`6.
`I understand that Touch ID was initially developed as part of a joint development
`effort between Apple and AuthenTec. I understand that, as part of Apple’s acquisition of
`AuthenTec, AuthenTec’s know-how and confidential technical information relating to its work on
`Touch ID now belong to Apple.
`7.
`I submit this declaration in support of sealing the information in the below
`documents as follows:
