`TO THE HONORABLE COURT, ALL PARTIES AND THEIR COUNSEL OF RECORD:
`PLEASE TAKE NOTICE THAT Plaintiffs provided nonparty Apple Inc. (“Apple”) with
`select materials in connection with Plaintiffs’ opposition to Qualcomm’s motion to dismiss,
`specifically Dkt. 900-1 (Expert Report of Einer R. Elhauge) and 900-2 (Reply Expert Report of
`Einer R. Elhauge). Defendant Qualcomm Inc. (“Qualcomm”) also recently provided Apple with
`additional select materials in connection with its motion for summary judgment, specifically a
`redacted version of that motion [Dkt. 936] and portions of Exhibits 3-6 and 8 to the Declaration
`of Cody S. Harris [Dkt. 936-1]. Having reviewed those materials in light of the Court’s order
`[Dkt. 922], Apple will not seek reconsideration of the Court’s order or otherwise seek to seal any
`information identified by the parties in the select material provided to Apple by the parties as set
`forth herein.
`Apple nonetheless requests that, in accordance with Civil Local Rule 79-5(f), the parties
`provide clear notice to nonparties like Apple of information they have designated confidential that
`the parties intend to file, and to coordinate with nonparties to minimize sealing burdens on them
`and the Court.
