`Pursuant to Civil Local Rules 6-1(b), 6-2, and 7-12, Plaintiff Finjan, Inc. (“Finjan”) and
`Defendant Juniper Networks, Inc. (“Juniper”) (collectively, the “Parties”), by and through their
`respective counsel, hereby stipulate to the following request to modify the case schedule to set a
`briefing schedule by which the parties will file their anticipated Daubert motions regarding damages
`experts:
`WHEREAS, on February 23, 2018, the Court issued a Case Management Order (Dkt. No. 34);
`WHEREAS, on February 23, 2018, the Court issued an Amended Case Management Order
`(Dkt. No. 35), which only amended the date of the pretrial conference;
`WHEREAS, Finjan’s damages expert Mr. Kevin M. Arst served a damages report on
`September 11, 2018;
`WHEREAS, the parties previously stipulated to move the deadline for Juniper to serve its
`rebuttal expert reports to November 7, 2018 to accommodate Finjan’s Rule 30(b)(6) witness on
`licensing issues, who could not be available for deposition until November 2, 2018;
`WHEREAS, the parties agreed that Mr. Arst would be deposed on November 9, 2018;
`WHEREAS, Juniper believes a motion to preclude Finjan’s Mr. Arst from testifying at trial is
`appropriate because his analysis is not “based on sufficient facts or data” and is not “the product of
`reliable principles and methods;”
`WHEREAS, the earliest date that Juniper’s damages expert, Dr. Keith Ugone, is available for
`his deposition after the rebuttal damages expert report deadline is November 13, 2018;
`WHEREAS, Finjan wishes to preserve the right to file a motion to preclude Dr. Ugone’s
`rebuttal report, should such a motion be warranted;
`WHEREAS, there is good cause to modify the schedule to allow the parties to file Daubert
`motions, as there is insufficient time between the depositions of the parties’ damages experts and the
`December 10, 2018 trial date for the parties to comply with the time limits under the local rules for
`noticed motion;
`WHEREAS, the parties have agreed to the following briefing and hearing schedule for the
`motion to preclude Mr. Arst’s testimony, and the motion to preclude Dr. Ugone’s testimony (if Finjan

`November 7, 2018):

`WHEREAS, the Parties have also agreed to reduce the default page limits for the motions to
`exclude as follows: Opening Briefs will be no more than 15 pages, Opposition Briefs will be no more
`than 15 pages, and Reply Briefs will be no more than 8 pages.
`WHEREAS, there are and have been no other modifications in the case related to the Court’s
`scheduling order, other than as described above; and
`WHEREAS, this requested time modification would not have an effect on the remaining
`schedule for the case.
