`Ltd. (collectively, the “Ubisoft and Square Enix Defendants”), requests that she be
`allowed to appear telephonically at the upcoming scheduling conference and
`hearing scheduled for December 21, 2020. Good cause exists to support counsel’s
`motion.
`
`Defendants’ lead counsel is located in Overland Park, Kansas, and to attend
`the hearing in person will require both air travel and an overnight stay. In
`particular, due to the COVID-19 pandemic, flight options are now more limited,
`and any air travel will require at least two flights each direction (i.e., to/from). The
`December 21, 2020 in-person proceedings are scheduled just days before the
`Christmas holiday, during a time period where travel in the United States is likely
`to be high and family gatherings will be occurring.
`The issues that are set for hearing on the Court’s December 21 calendar are
`not evidentiary in nature—a scheduling conference, and Ubisoft’s motion for
`judgment on the pleadings (Dkt. 67)—and counsel submits that they can be
`effectively and substantively addressed by telephonic argument.
`Accordingly, in view of the COVID-19 pandemic and the local restrictions
`and guidance suggesting that people minimize travel and exposure at this time, Ms.
`Marriott respectfully requests that she be permitted to attend the December 21
`proceedings by telephone. To the extent that the Court requires an in-person
`appearance for each party, Defendants’ Los Angeles-based counsel, Stephen
`Smith, is available to appear in person in accordance with the Court’s stated
`procedures, outside the courthouse doors, in addition to Ms. Marriott’s telephonic
`appearance.
`Counsel for the other parties, Plaintiff Uniloc 2017 and Defendant NetSuite
`Inc., do not oppose this request. If this request is granted, Ms. Marriott will make
`arrangements to participate in the hearing directly through the Court.
