`After a hearing on December 4, 2019, the Court issued a minute order, Dkt. No. 48,

`consolidating under 8:19cv1150-DOC (KESx) the four actions involving the above parties. In the
`
`same minute order, the Court stayed this consolidated action “pending the outcome of the Square
`
`Enix case pending in Texas Federal Court.” (Emphasis added.)
`
`On April 24, 2020, the Court issued a Scheduling Notice ordering the parties to file a Joint
`
`Status Report “regarding the Texas action” by May 8, 2020.
`
`The only pending Square Enix case in that district on December 4, 2019, was Uniloc 2017
`
`LLC v. Square Enix, No. 2:2019-cv-00221. There was, however, another pending case in that
`
`district, Uniloc USA, Inc. v. Big Fish Games, Inc., No. 2:16-CV-00741, which was also discussed
`
`at the December 4 hearing. From the discussion in open court, the parties believe the Court had
`
`intended the stay to be in effect pending the outcome of Big Fish, not Square Enix, and thus the
`
`reference in the minute order to the Square Enix Texas case was an error.

`In the Square Enix Texas action, filed on June 12, 2019, Uniloc served its P.R. 3-1 and 3-2
`

`disclosures – including its infringement contentions, and the Texas court has set a scheduling
`
`conference for May 18. On April 9, the defendants in that action moved to dismiss or transfer the
`
`action to this Court, based on the first-to-file rule. Uniloc 2017 has not yet filed its opposition.

`The Big Fish case, which had been filed in 2016, was the action appealed to the United
`

`States Court of Appeals for the Federal Circuit. As discussed at the December 4 conference, in July
`
`2019 the Federal Circuit remanded that action to that district court for further proceedings. On
`
`February 5, 2020, the Texas court denied Uniloc’s motion for reconsideration of its prior Order
`
`construing certain claim terms of the patents asserted in these consolidated cases. On March 12,
`
`2020, that Texas court scheduled that case for a trial beginning October 19, 2020.
