`Pursuant the deadlines in the parties’ Joint Stipulation to Amend Case Schedule
`
`(Dkt. No. 246) that were adopted by the Court during the September 18, 2023 status
`
`conference, Plaintiffs NantWorks LLC and Nant Holdings IP, LLC (“NantWorks”)
`
`and Defendants Bank of America Corporation and Bank of America, N.A. (“Bank of
`
`America”) jointly submit this status report.
`
`Fact Discovery: Fact Discovery is currently scheduled to close on November
`
`16, 2023. Depositions are ongoing, and most of the party witnesses’ depositions
`
`have been scheduled. NantWorks and Bank of America have been diligently
`
`working to schedule the remaining party witness depositions, as well as third-party
`
`depositions. Although the parties anticipate that the vast majority of depositions will
`
`take place by the November 16 deadline, a few—including a witness who is impacted
`
`by the current war in Gaza—may have scheduling conflicts that will require their
`
`depositions to be taken out of time.
`
`Mediation: The parties are scheduled to attend an in-person mediation before
`
`the Honorable Layn Phillips on October 31, 2023 in the Los Angeles area.
`
