`On February 26, 2018, Seoul Semiconductor Co., Ltd. and Seoul Semiconductor, Inc.
`
`(collectively, “Seoul”) filed a Motion to Stay Pending Inter Partes Review (“Motion to Stay”) in
`
`related case no. 8:17-cv-981-JVS-JCG. Seoul asked the Court to stay proceedings while the United
`
`State Patent and Trademark Office (“USPTO”) considers issues of validity with respect to U.S. Pat.
`
`Nos. 6,949,771; 7,256,486; and 7,524,087 asserted by Plaintiff Document Security Systems, Inc.
`
`(“DSS”). Mot. to Stay, Case 8:17-cv-981-JVS-JCG, ECF No. 57, at 1-2, 4 (Feb. 26, 2018). DSS has
`
`asserted the same three patents in this action against Everlight Electronics Co., Ltd. and Everlight
`
`Americas, Inc. (collectively, “Everlight”).
`
`Seoul’s motion was based, in part, on plaintiff’s track record of asserting patents that are
`
`ultimately determined to be invalid by the USPTO. Mot. to Stay 2-4. Under such circumstances, a
`
`stay would preserve judicial resources by avoiding unnecessary discovery, claim construction, and
`
`motion practice on patents later invalidated by the USPTO.1 The same or greater efficiencies would
`
`be obtained by a stay of proceedings in the present action with little likelihood of prejudice because
`
`the schedule in this action trails the schedule in Plaintiff’s case against Seoul. Accordingly, for these
`
`reasons, and all of the reasons articulated in Seoul’s Motion to Stay, Everlight hereby joins Seoul’s
`
`motion and asks the Court to stay this action pending the outcome of the USPTO’s consideration and
`
`inter partes review of U.S. Pat. Nos. 6,949,771; 7,256,486; and 7,524,087.

`1 Everlight understands that the defendants in related actions, Cree, Inc. (Case No. 2:17-cv-04263)
`and Lite-On, Inc. and Lite-In Technology Corporation (Case No. 2:17-cv-06050), do not oppose a
`stay pending IPR in their cases.
