`Defendants’ Proposal

`evidence presented by
`Plaintiff.
`
`
`
`Defendants’ Statement:
`
`Thirteen Inter partes review petitions have been filed across the four Asserted
`
`Patents.3 On June 7, 2018, IPR2018-00265 (’771 patent) was instituted on all claims.
`
`On June 21, 2018, IPR2018-00333 (’486 patent) was instituted on call claims.
`
`Defendants expect additional institution decisions in the coming months. As these
`
`IPR proceedings have significant implications for the issues in the case, including
`
`the construction of many of the disputed terms identified above, Defendants intend
`
`to move for a stay of the litigation. Defendants further reserve the right to
`
`supplement their claim construction submissions if information relevant to the
`
`meaning of the claim terms arises in the inter partes review proceedings.

`Plaintiff similarly reserves the right to supplement its claim construction
`
`submissions should new relevant information arise and respond to any Defendants’
`
`supplementation. Plaintiff will respond to Defendants’ arguments concerning a
`
`potential stay of litigation in response to a noticed motion or as otherwise ordered
`
`by the Court.
`
`III.
`
`IDENTIFICATION OF TERMS WHOSE CONSTRUCTIONS
`
`ARE MOST SIGNIFICANT TO RESOLUTION OF THE CASES.
`
`Pursuant to the order of the Court, the parties have agreed to present ten terms
`
`to the Court for construction. The Parties believe construction of these ten terms are
`
`most significant to resolution of the cases.
