`
`
`ORDER APPOINTING TECHNICAL ADVISOR
`
`The Court finds that the technology in the above-captioned case is exceptionally complex
`
`and warrants the appointment of a technical advisor. This case involves U.S. Patent No. 7,246,058,
`
`which is titled “Detecting voiced and unvoiced speech using both acoustic and nonacoustic
`
`sensors” and relates to voice detection technology; U.S. Patent No. 8,019,091, which is titled
`
`“Voice activity detector (VAD) -based multiple-microphone acoustic noise suppression” and
`
`relates to noise suppression technology; U.S. Patent No. 8,280,072, which is titled “Microphone
`
`array with rear venting” and relates to noise suppression technology; U.S. Patent No. 8,321,213,
`
`which is titled “Acoustic voice activity detection (AVAD) for electronic systems” and relates to
`
`noise suppression technology; U.S. Patent No. 8,326,611, which is titled “Acoustic voice activity
`
`detection (AVAD) for electronic systems” and relates to noise suppression t technology; U.S.
`
`Patent No. 8,467,543, which is titled “Microphone and voice activity detection (VAD)
`
`

`

`Case 6:21-cv-00984-ADA Document 69 Filed 07/01/22 Page 2 of 4
`
`configurations for use with communication systems” and relates to detection and processing an
`
`acoustic signal in a noisy environment; U.S. Patent No. 8,503,691, which is titled “Virtual
`
`microphone arrays using dual omnidirectional microphone array (DOMA)” and relates to noise
`
`suppression technology; U.S. Patent No. 10,779,080, which is titled “Dual omnidirectional
`
`microphone array (DOMA)” and relates to noise suppression technology; U.S. Patent No.
`
`11,122,357, which is titled “Forming virtual microphone arrays using dual omnidirectional
`
`microphone array (DOMA)” and relates to noise suppression technology.
`
`The patents are classified in the fields of data processing: speech signal processing,
`
`linguistics, language translation, and audio compression/decompression related to noise;
`
`acoustical noise or sound cancellation with counterwave generation control path; directive circuits
`
`for microphones; data processing: speech signal processing, linguistics, language translation, and
`
`audio compression/decompression related to voice or unvoice; noise or distortion suppression;
`
`damping circuit arrangements for transducers, e.g., motional feedback circuits; and transducers.
`
`The specification discusses identifying information of the acoustic signals as voiced speech
`
`based on thresholds (’058 Patent at Abstract), enabling acoustic noise suppression in multiple-
`
`microphone systems using Voice Activity Detectors (’091 Patent at Abstract), noise suppression
`
`for multi-microphone systems (’072 Patent at Abstract), generation of virtual directional
`
`microphones in order to generate a Voice Activity Detection signal (’213 Patent at Abstract, ’611
`
`Patent at Abstract), using control signals to automatically select a denoising method appropriate
`
`to data of frequency subbands of the acoustic signal (’543 Patent at Abstract), and formation of
`
`virtual microphones to reduce noise without distorting the speech and improving the signal-to-
`
`noise ratio of the desired speech (’691 Patent at Abstract, ’080 Patent at Abstract, ’357 Patent at
`
`Abstract)/

`Full appreciation of the parties’ upcoming arguments requires a detailed understanding of
`
`electrical engineering.1
`
`The Court hereby appoints Dr. Joshua J. Yi to serve as the Technical Advisor for the Court
`
`in this case. Given his background and qualifications, the Court is satisfied that Dr. Yi’s
`
`appointment pursuant to the terms of this Order would assist the Court in this case. Dr. Yi’s contact
`
`information is as follows:

`
`The parties shall send courtesy copies of the following documents no later than one
`
`business day after the date of this order or after the last document in the following list is filed:
`
`(1) Briefs, joint claim construction statement, and patents: In paper form, double-
`sided, stapled or bound (e.g., 3-ring), to the mailing address above,
`(2) Briefs, exhibits, joint claim construction statement, patents, and tutorial: In
`electronic form, on a USB drive, to the mailing address above,
`(3) Word version of the joint claim construction statement: Via e-mail to the above
`email address.
`
`If the document was filed with the Court, the copy must include the CM/ECF header.
`
`Dr. Yi will assist the Court with technical issues related to the claim construction process
`
`and advise the Court regarding preliminary and final claim constructions. Dr. Yi may also assist
`
`the Court in drafting a claim construction order.
`
`Finally, depending on the needs of the case, Dr. Yi may also assist the Court with motions
`
`for summary judgment, Daubert motions, trial preparation and rulings, post-trial motions, and any
`
`other Court task that requires an appreciation of the complex technology included in the asserted
`
`patents.
