`Pursuant to the request of the Board during the conference call that took place on January 21, 2020, in the above‐
`referenced cases (see Ex. 1190), we write to inform the Board that the deposition of Mr. Posillico will proceed by
`agreement of the parties on January 31, 2020, beginning at 10 AM ET.
`
`We note that this date is outside the time period that the Board ordered the deposition to occur, but counsel for
`Arkema understands that a scheduling conflict came up, and Mr. Posillico was no longer available on January
`28th. Counsel for Arkema is amenable to accommodating Mr. Posillico’s schedule and has agreed to the deposition on
`Friday, January 31, so long as the Board does not object.
`
`As requested on the call, Petitioner will submit the deposition transcript along with its briefing due February 10,
`2020. Please let us know whether the Board requires any additional information at this time.
