`Subject: Arkema v. Honeywell (PGR2016‐00011, ‐00012)
`
`
`Dear Board,
`
`
`On April 27, 2020, the panel granted Honeywell’s motion for leave to request a certificate of correction from the
`Director in PGR2016‐00011 and PGR2016‐00012 (PGR2016‐00011, Paper 57). Honeywell filed a petition for certificate of
`correction on May 5, 2020 with the Office of Petitions and supplemented that petition on May 6, 2020. On February 15,
`2022, the Office of Petitions dismissed Honeywell’s petition.
`
`
`We write to inform the panel of that dismissal, and to also inform the panel that Honeywell intends to petition the
`Director under 37 CFR § 1.181 for review of that dismissal. In light of Honeywell’s intention to petition the Director for
`review, it respectfully requests that the Board stay any certificate of cancellation under 37 CFR § 42.80 until the Director
`acts upon Honeywell’s petition.
`
`
`Arkema has informed Honeywell that it opposes Honeywell’s requested stay “at least because the rules do not allow for
`one. Specifically, Rule 1.181(f) states that ‘[t]he mere filing of a petition will not stay any period for reply that may be
`running against the application, nor act as a stay of other proceedings.’”
`
`
`Honeywell disagrees because 37 CFR § 42.80 states that a certificate will issue “[af]ter… the time for appeal has expired
`or any appeal has terminated….” The appropriate method for the Office to review (i.e., appeal) the dismissal of
`Honeywell’s certificate of correction request is by filing a petition to the Director.
`
`
`Best,
`
`
`Noah Frank
