`years. I have been employed in the Research & Information Services Department at

`Finnegan Henderson since 2019. Before that, from 1995-2015, I was employed in

`the Library Department of Sterne Kessler Goldstein & Fox. And from 2015-2019, I

`was employed in the Knowledge and Research Service Group (formerly,

`I have knowledge of and experience with standard library practices
`
`
`regarding receipt, cataloging, and shelving of materials. For example, I have
`
`knowledge of and experience with the Machine-Readable Cataloging (“MARC”)
`
`system that libraries use to catalog materials.
`
`
`
`Based on standard library practice, when a library receives an item, it
`
`stamps the item with the library name and often with a date that is within a few days
`

`or weeks of receipt. The library will catalog the item within a matter of a few days
`
`
`

`or weeks of receiving it.
`
`
`
`By the mid-1970s, standard library practice involved cataloguing items
`
`using the MARC system. The MARC system was developed in the 1960s to
`
`standardize bibliographic records so they could be read by computers and shared
`
`among libraries. By the mid-1970s, MARC had become the international standard
`
`for bibliographic data, and it is still used today.
`
` After an item is cataloged, standard library practice is to then shelve the
`
`item within a matter of a few days or weeks of cataloging it.
`
` Taking into account the few days or weeks between receiving an item
`
`and cataloging it, and the few days or weeks between cataloging an item and shelving
`
`it, the total time between receiving an item and shelving it ranges from a couple of
`
`weeks to a few months. The public can access an item after it is cataloged by
`
`searching the catalog and requesting the item from the library.
`
` MARC Records
` Many libraries provide public access to their MARC records via the
`
`Internet and/or their electronic cataloguing system at the library. In a MARC record,
`
`each field provides information about the cataloged item. MARC uses a simple
`
`three-digit numeric code (from 001-999) to identify each field in the record. For
`
`example, field 245 lists the title of the work and field 260 lists publisher information.
`

`Field 060 represents the National Library of Medicine Call Number. Field 060
`
`
`

`includes two indicators and several subfield codes. The first indicator provides
`
`information on whether the item at issue exists in the National Library of Medicine
`
`collection (blank = no information provided; 0 = item in the Library; 1 = item not in
`
`the Library). A subfield code starting with “$b” identifies a specific item number
`
`unique to the item (“Call” number).
`
` Libraries can create MARC records for various types of publications,
`
`including serial publications such as scientific journals. Serial publications are
`
`publications that have the same collective title but are published in a succession of
`
`discrete parts (e.g., volumes and issues), typically at regular intervals. MARC
`
`records for serial publications represent the entire run of the title. If a publication is
`
`a periodical, then its publication frequency is recorded in Field 310, and the
`
`publication dates (e.g., the first and last publication) are recorded in Field 362. With
`
`knowledge of the first issue or volume published, future issues or volumes can be
`
`predicted based on the information provided in the MARC record. Field 510
`
`identifies databases in which the publication has been indexed (e.g., PubMed).
`
` Attached as Exhibit A are explanations from the Library of Congress
`
`of the MARC records and fields.

` Exhibit 1021, submitted with Sarepta’s petition for inter partes review,
`
`is a true and correct copy of an article contained in the February 2010 issue of
`
`Neuromuscular Disorders (Volume 20, Issue 2). Exhibit 1021 includes an article
`
`entitled “Comparative analysis of antisense oligonucleotide sequences targeting
`
`exon 53 of the human DMD gene: Implications for future clinical trials” by Linda J.
`
`Popplewell, Cal Adkin, Virginia Arechavala-Gomeza, Annemieke Aartsma-Rus,
`
`Christa L. de Winter, Steve D. Wilton, Jennifer E. Morgan, Francesco Muntoni, Ian
`
`R. Graham, and George Dickson (“Popplewell”), which appears on pages 102–110
`
`of the issue. I obtained a copy of Exhibit 1021 from the National Library of
`
`Medicine in a condition that creates no suspicion about its authenticity. The text of
`
`Popplewell appears to be complete: no pages are missing, the text on each page
`
`appears to flow from one page to the next, and there are no visible alterations to the
`
`document.
`
` As shown on the first page of Exhibit 1021, the front page of the
`
`February 2010 issue of Neuromuscular Disorders has two stamps, indicating that
`
`this issue was collected as part of the “General Collection” of the National Library
`
`of Medicine:

`I also reviewed MARC records, which corroborate that the National
`
`Library of Medicine received the February 2010 issue of Neuromuscular Disorders
`
`that contains Exhibit 1021. Attached as Exhibit B to this Declaration is a copy of
`
`the MARC records for Neuromuscular Disorders at the National Library of
`
`Medicine. According to field 060 of the MARC records attached as Exhibit B, the
`
`Call number designated for the February 2010 issue is “NE337GB,” the same Call
`
`number shown in one of the stamps on the first page of Exhibit 1021. Field 060
`
`further indicates that the item continues to be available in the Library. See field 060
`
`entry in Exhibit B (first indicator being 0). In addition, according to the field 362 of
`
`the MARC records attached as Exhibit B, the National Library of Medicine has
`
`received Neuromuscular Disorders since its very first issue (“Vol. 1, no. 1-”) and
`
`continues to receive issues of the publication.
`
` Field 510 of the MARC records in Exhibit B further indicates that
`
`Neuromuscular Disorders was included in several well-known indices, including
`
`MEDLINE, PubMed, and Index Medicus. See field 510 entries in Exhibit B. I also
`
`located the PubMed record for Ex. 1021, which further confirms that Ex. 1021 was
`

`included in the PubMed index before August 31, 2011. See Exhibit C; see also
`

`Exhibit D (PubMed Data Element (Field) Descriptions). Field “EDAT” (Entrez
`
`Date), which refers to the date the citation was added to PubMed, indicates that the
`
`citation of Ex. 1021 was added to PubMed on January 19, 2010. See field EDAT
`
`entry in Exhibit C. Field “SO” (Source), which provides additional dates such as an
`
`electronic publication date (“Epub”), indicates that Ex. 1021 was electronically
`
`published on January 15, 2010. See field SO entry in Exhibit C. Consistent with the
`
`information in the MARC/PubMed records of Ex. 1021, the publisher’s website
`
`indicates that the print issue containing Popplewell was published on February 1,
`
`20101.
`
` Based on the fact that a print copy of Exhibit 1021 can be found in the
`
`National Library of Medicine, supported by the corresponding MARC/PubMed
`
`records attached as Exhibits B and C, it is my opinion that Popplewell’s serial title
`
`had been received, cataloged, and indexed at the National Library of Medicine and
`
`made part of its online catalog database on or shortly after February 1, 2010, and
`
`became available to the public on or shortly after that date. On or shortly after
`
`February 1, 2010, any member of the public could have located Popplewell by
`
`

`searching through the National Library of Medicine’s catalog by subject matter,
`
`
`

`author, or title. Similarly, interested researchers in the field would have been able
`
`to locate Popplewell on or shortly after February 1, 2010 via several well-known
`
`indices such as MEDLINE, PubMed, and Index Medicus by searching subject
`
`matter, author, or title. As such, Popplewell would have been available to the public
`
`before August 31, 2011.
`
` Not only was Popplewell accessible and available to researchers in the
`
`field as of August 2011, researchers did access and rely on this article in their works,
`
`further confirming its availability and accessibility. For example, Google Scholar,
`
`which is included as Exhibit E to this Declaration, indicates that Popplewell had
`
`been cited 96 times as of June 11, 2021, including being cited prior to August 31,
`
`2011. One such example is an article entitled “Gene therapy for muscle disease,” in
`
`the journal Experimental Cell Research, authored by Yuko Miyagoe-Suzuki and
`
`Shin’ichi Takeda, a copy of which is attached as Exhibit F to this Declaration. I
`
`understand that Shin’ichi Takeda is one of the named authors of the ’217 patent. As
`
`shown in Exhibit F, Popplewell is cited as Ref. #34 in this article. See Exhibit F,
`
`3091. According to the website for the journal Experimental Cell Research, Exhibit

`F became available online in May 2010.2 The fact that an article published before

`August 31, 2011 cited Popplewell further supports that Popplewell was available to
`
`the public before August 31, 2011.

` Exhibit 1022 (“Sazani”)
` Exhibit 1022, submitted with Sarepta’s petition for inter partes review,
`
`is a true and correct copy of an article contained in the March/April 2010 issue of
`
`International Journal of Toxicology (Volume 29, Number 2). Exhibit 1022 includes
`
`an article entitled “Safety Pharmacology and Genotoxicity Evaluation of AVI-4658”
`
`by Peter Sazani, Doreen L. Weller, and Stephen B. Shrewsbury (“Sazani”), which
`
`appears on pages 143–156 of the issue. I obtained a copy of Exhibit 1022 from the
`
`National Library of Medicine in a condition that creates no suspicion about its
`
`authenticity. The text of Sazani appears to be complete: no pages are missing, the
`
`text on each page appears to flow from one page to the next, and there are no visible
`
`alterations to the document.
`

`of Toxicology that contains Exhibit 1022. Attached as Exhibit G to this Declaration

`is a copy of the MARC records for International Journal of Toxicology at the
`
`National Library of Medicine. According to field 060 of the MARC records attached
`
`as Exhibit G, the Call number designated for the March/April 2010 issue is
`
`“JO908V,” the same Call number shown in one of the stamps on the first page of
`
`Exhibit 1022. Field 060 further indicates that the item continues to be available in
`
`the Library. See field 060 entry in Exhibit G (first indicator being 0). In addition,
`
`according to the field 362 of the MARC records attached as Exhibit G, the National
`
`Library of Medicine has received International Journal of Toxicology since the
`
`January/February 1997 issue (“Vol. 16, no. 1 (Jan.-Feb. 1997)”) and continues to

`receive the publication.

`as of August 2011, researchers did access and rely on this article in their works,

`further confirming its availability and accessibility. For example, Google Scholar,

`which is included as Exhibit I to this Declaration, indicates that Sazani had been
`
`cited 48 times as of June 11, 2021, including being cited prior to August 31, 2011.

`One such example is an article entitled “Restoring Dystrophin Expression in
`
`Duchenne Muscular Dystrophy Muscle: Progress in Exon Skipping and Stop Codon
`
`Read Through,” in the journal American Journal of Pathology, authored by Eric P.
`
`Hoffman, Abby Bronson, Arthur A. Levin, Shin’ichi Takeda, Toshifumi Yokota,
`
`Andreas R. Baudy, and Edward M. Connor, a copy of which is attached as Exhibit
`
`H to this Declaration. As noted earlier, I understand that Shin’ichi Takeda is one of
`
`the named authors of the ’217 patent. As shown in Exhibit J, Sazani is cited as Ref.
`
`#38 in this article. See Exhibit J, 21. According to the website for the journal

`The fact that an article published before August 31, 2011 cited Sazani further
