`within such an email to the Board. If the Board is inclined to consider Petitioner’s request, however,
`Patent Owner respectfully requests an opportunity to respond to the arguments in Petitioner’s email
`and to explain why there is no valid basis for Petitioner to submit briefing regarding the term
`“program code.”

`Petitioner in the above identified matter requests clarification of the Order entered on May 8, 2019
`(Paper 12). On page 3 the Order states “Although we are not authorizing briefing on this limitation,
`Petitioner is authorized to submit the district court’s order construing ‘program code.’”
`
`During argument, Petitioner’s counsel had pointed out that the order of the district court must be
`accompanied by the related Markman briefs of the respective parties to fully understand the
`significance of the district court’s order. In response to a specific question by Petitioner’s counsel as
`to whether the submission of the related accompanying briefs was also permitted, Judge Howard
`responded in the affirmative. The PTAB’s Order of May 8, however, makes no mention of the
`related accompanying briefs.
`
`Petitioner requests confirmation that it may also submit the parties’ Markman briefs that relate to
`the district court’s order construing “program code.”
`
