`
`
`[PROPOSED] ORDER
`
`Plaintiff Finjan, Inc.’s (“Finjan”) Motion for Relief from Judgement Pursuant to Federal Rule of
`
`Civil Procedure 60(b) was brought before the Court. Upon consideration of this motion and the
`
`pleadings and papers file in support of and opposition to the same, and GOOD CAUSE appearing
`
`therefor, this Court finds as follows:
`
`Finjan’s Motion for Relief from Judgement Pursuant to Federal Rule of Civil Procedure 60(b) is
`
`hereby GRANTED. Finjan has demonstrated that newly-discovered evidence and / or discovery
`
`misconduct by Defendant Juniper Networks, Inc. warrant relief from the jury verdict entered in this
`
`action on December 14, 2018 and this Court’s subsequent denial of Finjan’s Motion for Judgment as a
`
`Matter of Law on March 11, 2019. Finjan is entitled to a new trial on the issues of infringement and
`
`damages. The Court will issue a scheduling order for a new trial on these issues.
`
`
`
`IT IS SO ORDERED.
